Please read carefully. These Terms include a binding arbitration agreement and class-action waiver in Section 15 that affect how disputes are resolved.

1. Agreement to these Terms

These Terms of Service (“Terms”) are a legal agreement between you and ESCAAPE LLC, a limited liability company based in the United States (“ESCAAPE”, “we”, “us” or “our”), which operates Myvo, including the website at myvo.travel and the Myvo mobile applications (together, the “Service”). By accessing or using the Service, creating an account, or making a booking, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & accounts

  • You must be at least 18 years old and able to form a binding contract to create an account or make a booking.
  • When booking for others, you confirm that you are authorized to act on their behalf, to accept these Terms for them, and to provide their personal information to us.
  • You agree to provide accurate, current and complete information and to keep it up to date.
  • You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly at support@myvo.travel of any unauthorized use.

3. Our role

Myvo is a travel booking platform. Unless we clearly state otherwise at the time of booking, we act as an intermediary that facilitates bookings between you and independent third-party travel suppliers such as airlines, hotels, property owners, tour operators, car rental and transfer companies (“Suppliers”). The travel services are provided by the Supplier, not by ESCAAPE.

Your booking is subject to the Supplier's own terms, conditions, fare rules and policies (for example, airline conditions of carriage and hotel cancellation policies), which will be made available to you before you book and form part of your contract with that Supplier. Suppliers are independent businesses; we are not responsible for their acts, omissions, representations, warranties, negligence, or for any personal injury, death, property damage or other loss arising from the travel services they provide.

4. Bookings & prices

  • A booking is confirmed only when you receive a confirmation from us containing a booking reference.
  • Prices and availability are provided by Suppliers and can change at any time until your booking is confirmed. We show the total price, including applicable taxes and fees known to us, before you confirm.
  • Some charges may be payable directly to the Supplier at the destination (for example resort fees, city or tourist taxes, or deposits). Where we know about them, we will disclose them before you book.
  • Ratings, descriptions and photos are provided as a guide based on information from Suppliers and other sources, and are not a guarantee.
  • If a price is displayed in obvious error, we or the Supplier may cancel the booking and refund any amount you paid.
  • Where required by law, applicable seller-of-travel registration information will be displayed in the Service.

5. Payments

You authorize us, our payment processors, or the Supplier (as indicated at checkout) to charge your selected payment method for the total amount of your booking. Payments are processed by third-party payment processors and are subject to their terms. Depending on the booking, the charge may appear on your statement from ESCAAPE, Myvo, our payment processor, or the Supplier. If your payment is declined or reversed, we may cancel the related booking. Your bank may charge foreign transaction or currency conversion fees, for which we are not responsible.

6. Changes, cancellations & refunds

  • Changes and cancellations are governed by the Supplier's rules for your specific booking, which are shown before you book. Some fares and rates are non-refundable and non-changeable.
  • Supplier change or cancellation fees may apply, and we may charge a service fee for processing changes; any such fee will be shown to you before you confirm the change.
  • Refunds are issued to the original payment method once received from the Supplier and may take several weeks to appear.
  • For flights to, from or within the United States, you may be entitled to cancel and receive a full refund within 24 hours of booking where the booking is made at least seven days before departure, in accordance with U.S. Department of Transportation rules and the airline's policy.
  • If a Supplier cancels or materially changes your booking, we will notify you as soon as reasonably practicable and help you with the options the Supplier makes available, which may include a refund or alternative arrangements.

7. Travel documents, health & safety

You are solely responsible for ensuring that you and all travelers on your booking have valid passports, visas, transit permits, health certificates, vaccinations and any other documents required for your trip, and for checking official government travel advisories. Names on bookings must exactly match travel documents. We are not responsible if you are refused boarding or entry. We strongly recommend purchasing appropriate travel insurance.

8. Acceptable use

You agree not to:

  • Use the Service for any unlawful, fraudulent or speculative booking, or to make bookings you do not intend to use;
  • Resell, scrape, crawl, copy or use automated means to access the Service or its content without our written permission;
  • Interfere with, disrupt or attempt to gain unauthorized access to the Service, its systems or other users' accounts;
  • Reverse engineer, decompile or disassemble the app except as permitted by law;
  • Post content that is unlawful, misleading, defamatory, obscene, hateful, infringing or otherwise objectionable; or
  • Impersonate any person or misrepresent your affiliation with any person or entity.

9. Your content

If you submit reviews, photos, feedback or other content (“Your Content”), you retain ownership of it but grant ESCAAPE a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, modify and distribute Your Content in connection with operating and promoting the Service. You confirm that you have the rights to Your Content and that it complies with these Terms. We may remove any content at our discretion. We have no tolerance for objectionable content or abusive users, and you may report such content to support@myvo.travel.

10. Intellectual property

The Service, including its software, design, text, graphics, logos and the Myvo name and marks, is owned by ESCAAPE or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial travel purposes. All rights not expressly granted are reserved.

11. Mobile app terms (Apple App Store & Google Play)

If you download the Myvo app from the Apple App Store, the following terms also apply. If you download it from Google Play, you also agree to Google Play's terms of service.

  • Parties. These Terms are between you and ESCAAPE only, and not with Apple Inc. (“Apple”). ESCAAPE, not Apple, is solely responsible for the app and its content.
  • Scope of license. Your license to use the app is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
  • Maintenance and support. ESCAAPE is solely responsible for providing maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services.
  • Warranty. ESCAAPE is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Product claims. ESCAAPE, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy or similar legislation.
  • Intellectual property claims. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, ESCAAPE, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
  • Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data service agreement).
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

12. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, ESCAAPE disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that information provided by Suppliers is accurate or complete.

13. Limitation of liability

To the fullest extent permitted by law, ESCAAPE and its members, managers, employees, affiliates and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or enjoyment, arising out of or relating to the Service or any travel services, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the service fees you paid to ESCAAPE for the booking giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold harmless ESCAAPE and its members, managers, employees, affiliates and agents from any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.

15. Dispute resolution & arbitration

Informal resolution first. Before filing a claim, you agree to contact us at support@myvo.travel and try to resolve the dispute informally for at least 30 days.

Binding arbitration. If we cannot resolve the dispute informally, you and ESCAAPE agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration may be conducted by video conference, by telephone, or based on written submissions. Judgment on the award may be entered in any court of competent jurisdiction. This agreement is governed by the Federal Arbitration Act.

Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.

Class action waiver. You and ESCAAPE agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding.

Opt-out. You may opt out of this arbitration agreement by emailing support@myvo.travel with the subject “Arbitration Opt-Out”, your name and account email within 30 days of first accepting these Terms.

16. Governing law & venue

These Terms are governed by the laws of the United States and the laws of the State in which ESCAAPE LLC is organized, without regard to conflict-of-law principles. Subject to Section 15, any action that is not subject to arbitration will be brought exclusively in the state or federal courts located in that State, and you consent to their jurisdiction. If you are a consumer residing outside the United States, you may also benefit from mandatory consumer protection laws of your country of residence.

17. Termination

You may stop using the Service and delete your account at any time in the app under Profile → Settings → Delete account. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Termination does not affect confirmed bookings, which remain subject to the Supplier's terms, or provisions of these Terms that by their nature should survive.

18. General

  • Changes. We may update these Terms from time to time. If changes are material, we will give notice through the Service or by email before they take effect. Continued use after the effective date means you accept the updated Terms.
  • Entire agreement. These Terms, together with the Privacy Policy and any Supplier terms applicable to your booking, are the entire agreement between you and ESCAAPE regarding the Service.
  • Severability. If any provision is found unenforceable, the remaining provisions will remain in full effect.
  • No waiver. Our failure to enforce any right is not a waiver of that right.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
  • Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control, including natural disasters, pandemics, war, strikes, government action or failures of Suppliers or networks.
